Terms of Service

1. Who provides the services

Services offered on kimberlyrosales.com, including sessions, website, branding, online store and launch projects, and Venture Architecture engagements, are provided by Kimberly Rosales, an individual based in Québec, Canada (“Kimberly”, “we”, “us”). Payments for these services are made to Kimberly Rosales.

These services are separate from ChainMyne. ChainMyne does not provide, endorse or guarantee them, and they are not ChainMyne products or financial services.

2. What these terms cover

These terms apply when you book a session or engage Kimberly for a project. For projects, the written proposal you approve forms part of your agreement; if it conflicts with these terms, the proposal prevails for that project.

3. Sessions

• Sessions are booked online and paid at the time of booking, unless otherwise agreed in writing.
• Sessions take place by video at the time you choose. Please join on time; the session ends at its scheduled time.
• Rescheduling, cancellation and refunds follow the Refund & Cancellation Policy.

4. Projects

• Projects begin with a discovery call and a written proposal describing the scope, deliverables, timeline and price.
• Work starts once you approve the proposal and pay the deposit stated in it. Remaining payments are due as set out in the proposal.
• Changes outside the agreed scope are quoted separately and begin only once you approve them.
• Timelines depend on you providing content, access and feedback when needed. Delays in those inputs may move the schedule.
• Third-party costs (for example domains, hosting, platform subscriptions, apps, payment-processing fees, stock assets) are paid by you directly unless the proposal says otherwise.

5. Prices, taxes and payment

Prices are in Canadian dollars. Applicable taxes are added where required. Payments are processed securely by our payment providers; card details are not received or stored by this website.

6. Your materials and ownership

• You keep ownership of the content, logos, images and other materials you provide, and confirm you have the right to use them.
• Once a project is paid in full, you own the final deliverables created specifically for you, subject to the licences of any third-party fonts, images, themes, platforms or software they rely on.
• Kimberly keeps her general know-how, methods, templates and tools, and may describe the nature of the work in general terms. Your name, work or results are shown publicly only with your permission.

7. Confidentiality

Information you share about your business is kept confidential and used only to provide the services, except where disclosure is required by law. See the Privacy Notice.

8. No guarantees, and no regulated advice

Services are provided with care and skill, but no particular result is guaranteed, including revenue, customers, search rankings, funding or business success, which depend on factors outside our control.

Services are educational and strategic. They are not financial, investment, legal, tax, accounting or regulatory advice, and they do not include recommendations to buy or sell any asset. Please consult a qualified professional for those matters.

9. Responsibility

To the extent permitted by law, Kimberly’s responsibility for any claim relating to a service is limited to the amount you paid for that service. Nothing in these terms limits rights you have under consumer-protection laws that cannot be excluded.

10. Governing law

These terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there.
